Candidate Privacy Notice
1. What personal data do we collect?
Saipem Guyana Inc. (hereinafter “SAIPEM”, “we”, “us” or “our”) collects and stores various types of personal data about individuals seeking employment with our company. This includes personal data contained in:
• resumes and/or job applications;
• references and interview notes;
• photographs and videos;
• letters of offer and acceptance of employment; and
• background check information.
In addition to the examples above, personal data also includes information such as the applicant's name, home address, telephone number, personal email address, date of birth, identity card number, parentage and marital status and any other information necessary for SAIPEM's professional purposes that was voluntarily disclosed at the time of applying for employment with SAIPEM.
We may also collect certain demographic information that may be considered sensitive personal information, such as race, ethnicity, sexual orientation, and disability, to help us understand the diversity of our workforce. This information is collected on a voluntary and consensual basis.
Most of the time, the personal data we request from job applicants is collected directly from them. In some cases, we may collect personal data about applicants from third parties, for example, when we conduct background checks that are necessary for the role to be performed. In most circumstances, we will seek your consent before collecting personal data about you from a third party.
In the event that we are required to ask you to provide any other personal information not described above, we will identify the nature and purpose of the collection at the time we collect it.
2. How do we use personal data?
Personal data relating to candidates is used and disclosed for professional purposes, in order to determine eligibility for employment and to carry out reference and qualification checks.
We may also use your personal data for other lawful purposes about which we will inform you and, if required by applicable law, we will obtain your consent to collect and use it.
3. Who do we share your data with?
We only allow employees of SAIPEM and its affiliated companies to have access to your personal data so that they can contact you if you are eligible for employment.
We may share your personal data with other employees, affiliated companies, contractors, consultants, and service providers who need the data to help SAIPEM compile or manage its list of potential candidates. When we share personal data with these parties, we require that they use or disclose the personal data only under SAIPEM's instructions and in a manner consistent with SAIPEM's Privacy Policy and this Privacy Notice.
In the event that we undertake a business sale, merger, reorganization, dissolution, or other similar event, the personal data we collect about you may be transferred in connection with such transactions. Any acquirer or successor of SAIPEM may continue to use the data as described in this notice, provided that the acquirer or successor is bound by appropriate agreements or obligations and may only use or disclose your personal data in a manner consistent with the use and disclosure provisions of this notice, or unless you otherwise consent.
We may also disclose your personal data to a third party in the following circumstances:
• to fulfill a legal obligation to which SAIPEM and its affiliated companies are subject;
• for the performance of a mission of public interest or relating to the exercise of public authority, with which SAIPEM and its affiliated companies are vested or with which the third party to which the data is communicated is vested;
• for the performance of a contract to which the data subject is a party or for the performance of pre-contractual measures taken at their request;
• for the protection of the interests or fundamental rights and freedoms of the person concerned; or
• with your express consent.
4. International operations and transfers outside your home territory
Your personal data may be collected, used, processed, stored, or disclosed by us and our service providers outside of Guyana. These countries may have data protection laws that differ from the laws of Guyana.
In the event of a transfer of personal data to another country, including within the SAIPEM group of companies, this transfer will take place in accordance with current Guyana legislation relating to the protection of personal data.
5. How do we protect your data?
We employ appropriate technical and organizational security measures to protect your personal data, both online and offline, in accordance with personal data protection laws.
6. How long do we keep your personal data?
We adhere to our Data Retention Policy and the retention schedules adopted therein to guide our retention practices. We will retain your personal data for twelve (12) months.
When we no longer have a legitimate business need to retain your personal data, we will either delete or anonymize it or, if this is not possible (for example, because your personal data has been stored in backup archives), then we will securely store it until deletion is possible.
7. How can you access and update your personal data?
It is important that the information in our records is both accurate and up-to-date. If your personal data changes during the retention period, please let us know.
You may also ask us to delete personal data that you believe is inaccurate or no longer relevant, using the same method.
Please note that we may refuse you access to personal data or delete it in certain cases, in particular if giving you access to it infringes the personal data protection rights of another person or if we are compelled to do so by legal obligation (ongoing judicial investigation, etc.).
