Dati trattati e fonte dei dati

Le precisiamo che tutti i dati personali saranno trattati in conformità alla vigente normativa in materia privacy. Pertanto, la Società si impegna a trattarli secondo principi di correttezza, liceità, trasparenza, nel rispetto delle finalità di seguito indicate, raccogliendoli nella misura necessaria ed esatta per il trattamento, consentendone l’utilizzo solo da personale allo scopo autorizzato e formato ed al fine di garantire la necessaria riservatezza delle informazioni fornite.

In particolare, la Società raccoglie, registra, consulta e in generale tratta i suoi dati anagrafici, quali a titolo esemplificativo nome, cognome, luogo e data di nascita, titolo di studio, esperienze lavorative, nonché le categorie particolari di dati, quali informazioni idonee a rilevare il suo stato di salute (come l’appartenenza a categorie protette) ed ogni altro dato da Lei inserito nel CV.

I dati sono raccolti direttamente presso l’interessato e/o presso terzi, quali società di recruiting.

Finalità del trattamento,Basi giuridiche del trattamento e Tempo di conservazione

• Ricerca e selezione del personale, anche per lo sviluppo di progetti di tirocinio e stage.
  • La base giuridica per il trattamento dei dati comuni è l’esecuzione di misure precontrattuali adottate su Sua richiesta e, per i dati particolari, la necessità di adempiere ad obblighi o esercitare diritti previsti dalle leggi applicabili in materia di diritto del lavoro (ai sensi dell’art. 9 co. 2, lett. b) del GDPR).
  • I dati personali saranno conservati per 12 mesi dall’ultimo aggiornamento del Suo CV, salva la necessità di conservazione per le ulteriori finalità di cui ai punti 2 e 3.
• Nell’ipotesi di controlli interni della Società per assolvere agli obblighi di tracciabilità e trasparenza, archiviazione della scheda informativa compilata durante lo svolgimento del colloquio e del CV.
  • La base giuridica che legittima il trattamento dei dati comuni è il legittimo interesse del Titolare.
  • I dati personali saranno conservati per un termine massimo di 10 anni dalla chiusura del processo di selezione.
• Se necessario, per accertare, esercitare e/o difendere i diritti della Società in sede giudiziaria, amministrativa o nelle procedure di arbitrato e conciliazione.
  • La base giuridica che legittima il trattamento dei dati comuni è il legittimo interesse del Titolare. Invece, la base giuridica per i trattamenti delle categorie particolari dati è l’accertamento, l’esercizio o la difesa di un diritto in sede giudiziaria, rispettivamente ai sensi dell’art. 9, par. 2, lett. f) del GDPR.
  • Per tutta la durata del contenzioso, fino all’esaurimento dei termini di esperibilità delle azioni di impugnazione.

Decorsi i termini di conservazione sopra indicati, i dati personali saranno distrutti o resi anonimi, compatibilmente con le procedure tecniche di cancellazione e backup.

Modalità di trattamento e conferimento dei dati

Il trattamento sarà svolto in forma digitale e/o tradizionale, con modalità e strumenti volti a garantire la massima sicurezza e riservatezza, ad opera di soggetti a ciò appositamente incaricati.

Nel caso di candidatura online, attraverso il portale presente sul sito web della Società, il conferimento dei dati contrassegnati da un asterisco (*) è necessario per prendere in considerazione la Sua candidatura nell’attività di ricerca e selezione del personale. Il mancato conferimento dei dati non consente lo svolgimento di tale attività e, di conseguenza, la Sua candidatura non potrà essere presa in considerazione.

Destinatari e trasferimento dei dati

La Società — senza che sia necessario richiedere il Suo specifico consenso — può comunicare i Suoi dati personali a categorie di soggetti di seguito meglio indicati quali ad esempio:

• Società del Gruppo Saipem anche non presenti all’interno dell’UE (sulla base delle decisioni di adeguatezza della Commissione Europea o sulla base delle standard contractual clauses), al fine di svolgere le attività previste dal processo di candidatura;
• soggetti terzi (a titolo indicativo, società fornitrici di servizi informatici, società di recruiting) anche non presenti all’interno dell’UE (sulla base delle decisioni di adeguatezza della Commissione Europea o sulla base delle standard contractual clauses), che svolgono attività in outsourcing per conto del Titolare, nella loro qualità di responsabili del trattamento;
• Autorità giudiziarie od organismi di controllo, nonché a quei soggetti terzi ai quali la comunicazione sia obbligatoria per legge. Detti soggetti tratteranno i dati nella loro qualità di autonomi titolari del trattamento.

I Suoi dati non saranno soggetti a diffusione.

I diritti dell’interessato

L’interessato ha il diritto di chiedere al Titolare l’accesso ai dati personali che La riguardano, la loro rettifica, la cancellazione, la portabilità, l’opposizione al trattamento nonché l’integrazione dei dati personali incompleti e la limitazione del trattamento nei casi previsti dall’art. 18 GDPR. Inoltre, ove applicabile, potrà revocare il consenso prestato in qualsiasi momento.

Tali diritti possono essere esercitati in qualsiasi momento, nei confronti del Titolare, inviando un’apposita richiesta per iscritto all’indirizzo e-mail dpo@saipem.com o privacy@saipem.com .

Inoltre, ha il diritto di proporre reclamo al Garante per la protezione dei dati personali e di ricorrere agli altri mezzi di tutela previsti dalla normativa applicabile.

Personal Data Processed

Please note that all the personal data provided will be processed in accordance with current legislation on privacy. Therefore the Company undertakes to process said data in accordance with the principles of fairness, lawfulness and transparency, in compliance with the purposes set out below, collecting said data only for specified and necessary purposes. Only authorised and properly trained personnel will be allowed to use said data in order to guarantee the necessary confidentiality of the information provided.

In particular, the Company will collect, record, consult and generally processes your personal data such as, but not limited to, your name, surname, place and date of birth, educational qualification, work experience, as well as special categories of data, which information suitable for detecting your health status (such as membership in protected categories) and any other data you provided in the CV.

Data are collected directly from the data subject and/or from third parties, such as recruiting companies.

Purpose of the processing,Legal basis of the processing and Retention period of data

• Recruitment and selection of personnel also to begin an internship program.
  • The lawfulness of processing for common data is the execution of pre-contractual measures taken at your request; for special categories of personal data, it is the need to fulfill obligations or exercise the rights set out in applicable legislation on employment (pursuant to art. 9 co. 2, lett. b) of GDPR).
  • Personal data will be stored for 12 months from the last update of your CV, except for the need to retain it for further purposes such as those set out in points 2 and 3.
• In case of internal controls of the Company in order to comply with the obligations of traceability and transparency, filing of the information sheet filled in during the interview and the CV.
  • The lawfulness of processing for common data is the legitimate interest of the Data Controller.
  • Personal data will be stored for a maximum of 10 years after the end of the selection process.
• If necessary, to assert or defend a right of the Company in court or in arbitration and conciliation procedures.
  • The lawfulness of processing for the common data is the legitimate interest of the Data Controller. With regard to special categories of data the lawfulness of processing is to establish, exercise or defend the rights in court pursuant to art. 9. paragraph 2, lett. f) of GDPR).
  • For the duration of any legal disputes until completion of the terms of implementation outlined in legal remedies.

Once the retention period has elapsed the data will be destroyed or made anonymous compatibly with technical erasure and backup procedures.

Way of processing and provision of data

The processing will be carried out in digital and/or traditional form, with methods and tools aimed at ensuring maximum security and confidentiality, by persons specifically appointed for this purpose.

In case of online application, through the Company’s website, the provision of data marked with an asterisk (*) is necessary to take your application into consideration in the recruitment and selection process. A refusal to provide data makes these activities impossible, and as a result your application cannot be considered.

Recipients and data transfer  

The Company - without needing specific consent - may communicate personal data to other subjects, the categories of which are described in detail below, for example:

• Saipem Group companies, even if not located in the EU (based on the adequacy decisions by the European Commission or on the basis of standard contractual clauses), in order to carry out the activities required by the application process;
• Third parties (by way of indication, companies providing IT services, recruiting companies), including those not located within the EU, who carry out outsourcing activities on behalf of the Controller, in their capacity as data processors. The transfer of data to countries outside the EU is guaranteed by the adequacy decisions of the European Commission or on the basis of standard contractual clauses;
• Judicial authorities, as well as those subjects to whom communication is required by law. These subjects will process the data in their capacity as independent Data Controllers.

Data will not be subject to disclosure.

Data Subjects rights

Data Subjects have the right to ask the Controller for access to their personal data, rectification, deletion or portability of their personal data, integration of incomplete personal data, limitation of processing in the cases provided for by art. 18 GDPR.  In addition, where applicable, Data Subjects may revoke their consent at any time.

These rights can be exercised at any time, against the Controller, by sending a specific request in writing to the e-mail addresses dpo@saipem.com or privacy@saipem.com.

Data Subjects have also the right to lodge a complaint to the competent Supervisory Authority and to use other means of protection provided by applicable law.

Among the Personal Information collected by this Site through the contact form and the form for spontaneous applications there are: Cookies, Usage Data, Email, Password, Name, Surname.

Other Personal Data collected may be indicated in other sections of this privacy policy or through informative texts displayed together with the collection of the Data.

Personal Data is entered voluntarily by the User.

Any use of Cookies - or other tracking tools - by this Site, unless otherwise specified, has the purpose of identifying the User and recording the related preferences for purposes strictly related to the provision of the service requested by the User.

The Data Controller reserves the right to make changes to this privacy statement at any time by giving notice to Users on this page.
