Candidate Privacy Notice
1. What Personal Data Do We Collect?
Saipem America Inc. (hereinafter “SAIPEM,” “we,” “us,” or “our”) collects and maintains various categories of personal data regarding individuals who apply for employment with the company. Such personal data may include, but is not limited to:
- Resumes, curricula vitae, and/or job applications;
- References, interview notes, and recruiter assessments;
- Photographs, video recordings, and other submitted media.
- Letters of offer, acceptance of employment, and related correspondence; and
- Pre-employment screening and background check information.
Additionally, personal data may include identifying and demographic information such as name, home address, telephone number, personal email address, date of birth, government-issued identification number, marital status, and any other information voluntarily disclosed by the applicant for legitimate professional purposes of SAIPEM.
Certain categories of sensitive personal information (e.g., race, ethnicity, sexual orientation, disability status, or veteran status) may also be collected strictly on a voluntary and consensual basis, for the purpose of compliance with applicable laws and to support diversity, equity, and inclusion objectives.
In most instances, personal data is collected directly from the applicant. However, SAIPEM may also obtain personal data from third parties, including, without limitation, references and background check providers, where permitted by applicable law and with prior consent when legally required.
Should SAIPEM request personal data not expressly described above, the nature and purpose of such collection will be communicated at the time of collection.
2. How Do We Use Personal Data?
Personal data of candidates is processed for legitimate business and professional purposes, including, but not limited to:
- Evaluating qualifications and determining eligibility for employment;
- Conducting reference checks, background verifications, and credential validation; and
- Complying with applicable legal, regulatory, and corporate governance requirements.
Personal data may also be processed for other lawful purposes, provided that such purposes are consistent with applicable data protection legislation. Where required, SAIPEM will obtain the candidate’s consent.
3. With Whom Do We Share Personal Data?
Access to candidate personal data is restricted to employees of SAIPEM America Inc. and its affiliated entities with a legitimate business need to review such data for recruitment purposes.
Personal data may also be disclosed to SAIPEM affiliates, contractors, consultants, and service providers engaged in recruitment, candidate evaluation, or related administrative support. Such parties are required to process personal data only in accordance with SAIPEM’s instructions, this Privacy Notice, and applicable legal obligations.
In the event of a corporate transaction, including but not limited to a merger, acquisition, sale, reorganization, or transfer of business operations, personal data may be transferred to the acquiring or successor entity subject to appropriate safeguards.
In addition, SAIPEM may disclose personal data:
- Where necessary to comply with legal or regulatory obligations.
- For the protection of SAIPEM’s rights, property, and interests, or those of its employees and affiliates.
- Where necessary to protect the vital interests of an individual; or With the express consent of the data subject.
4. International Data Transfers
Candidate personal data may be collected, stored, processed, or otherwise transferred to jurisdictions outside the United States, including to other SAIPEM affiliates or service providers located in countries with different data protection regimes.
Any such transfers will be carried out in compliance with applicable data protection legislation and subject to appropriate contractual, technical, and organizational safeguards to ensure a level of protection consistent with this Notice.
5. Data Security
SAIPEM employs technical, administrative, and organizational security measures designed to protect personal data against accidental, unlawful, or unauthorized access, disclosure, alteration, loss, or destruction, in accordance with applicable U.S. federal, state, and international data protection laws.
6. Data Retention
Candidate personal data will be retained in accordance with SAIPEM America’s Data Retention Policy. As a rule, candidate data will be retained for twelve (12) months from the date of collection, unless a longer retention period is required by law, is necessary for the establishment, exercise, or defense of legal claims, or is otherwise permitted for legitimate business purposes.
At the conclusion of the retention period, personal data will be securely deleted, anonymized, or otherwise disposed of in accordance with SAIPEM’s data retention and disposal protocols.
7. Candidate Rights
Candidates may request access to, correction of, or deletion of their personal data, subject to applicable legal restrictions and SAIPEM’s legitimate business needs.
SAIPEM may deny such requests where disclosure would infringe upon the rights of third parties, conflict with ongoing legal or regulatory obligations, or otherwise be restricted by applicable law.
