Information notice regarding the processing of Personal Data of Candidates
Data Controller and Contact Point
Your personal data are processed by SERVIZI ENERGIA ITALIA– Succursale Côte d’Ivoire (SEI) or SAIPEM (Portugal) Comercio Maritimo Sociedade Unipessoal LDA-Succursale Cote d’Ivoire (SPCM) as data controller and the persons or legal entities which process these data on SEICI or SPCM behalf as data processors.
Personal Data Processed
This Information Notice on the Processing of Personal Data of Candidates (Information Notice) applies to all personal data that you (you or Candidate) provide or that are provided to or collected by or on behalf of SEICI or SPCM in connection with your application for a job position with SEICI or SPCM and your evaluation for that position.
Please note that all of the personal data will be processed in accordance with SAIPEM, in the version applicable and any ordinances, guidelines and information sheets issued thereunder by SAIPEM or any other competent public authority, and any other data protection laws that may be applicable. The Company undertakes to process your personal data in accordance with the principles of fairness, lawfulness and transparency, in compliance with the purposes set out below and only insofar as necessary for these specified purposes. Only authorized and properly trained personnel will be allowed to process your data.
The Company will collect, record, consult and generally process your personal data, among others name, surname, address, phone number, e-mail-address, place and date of birth, educational qualifications, prior activities and professional affiliations, name of reference persons, testimonials, and any other data provided by you or collected lawfully by or on behalf of SAIPEM, including sensitive personal data.
SAIPEM may ask you to provide a medical certificate stating whether you are fit for the job for which you apply.
SAIPEM recruitment officers may ask you for additional information necessary for the application and evaluation process. A refusal to provide data requested may mean that your application cannot be considered.
SAIPEM will process any personal data, including sensitive personal data, insofar as necessary for the application and evaluation process. Any personal data submitted through the communication feature of social media platforms and applicant tracking system/website, is subject to the data privacy policy of the respective social media platform/applicant tracking system/website in addition to this Information Notice.
1.Purpose of the processing
Registration for a job application through our web-based online application tool, by e-mail to SEICI and SPCM or any of its affiliates, via our external agencies, or through the communication function of social media platforms.
Legal basis of the processing
We employ appropriate technical and organisational security measures to protect your personal data, both online and offline, in accordance with the applicable Ivorian legislation on the protection of personal data.
Retention period of data
We adhere to our data retention policy and the retention schedules adopted in this context to guide our retention practices. We will retain your personal data for a period not exceeding 12 months. Usually this means that we will retain your personal data until your employment with our company is terminated and thereafter for a reasonable period of time where it is necessary to respond to inquiries about such employment, manage legal, tax, accounting or administrative matters, or to provide your pension benefits or other ongoing benefits.
2.Way of processing and provision of data
Personal data related to employees is used and disclosed for business purposes, including establishing, managing or terminating your employment relationship with SAIPEM. These purposes include in particular
Determining eligibility for employment, including reference and qualification checks;
Payroll and benefits management;
The processing of work-related employee claims (workers compensation,insurance/benefit claims, etc.)
The identification and establishment of training and/or development programmes;
The evaluation of our entire workforce, as well as employee participation, engagement and satisfaction;
Reviewing performance and identifying performance requirements;
Assessment of qualifications for a particular job or task;
The collection of evidence justifying disciplinary measures or dismissal;
The establishment of a contact point in case of emergency; Any other purposes reasonably required by SAIPEM in connection with your employment; and
Any other legitimate purposes, reasonably required for day-to-day operations, such as accounting, financial reporting and business planning.
We may also use your personal data for other lawful purposes of which we will inform you and, if required by applicable laws, we will seek your consent to collect and use it. Your personal data may be collected, used, processed, stored or disclosed by us and our service providers outside of Côte d'Ivoire. These countries may have data protection laws that differ from the laws of Côte d'Ivoire.
In the case of a transfer of personal data to another country, including within the SAIPEM group of companies, this transfer will be carried out in accordance with the Ivorian legislation, in force, relating to the protection of personal data.
3.Data Subjects rights
You have the right to ask SAIPEM as the data controller for access to your personal data, and for rectification, erasure, and hand-over of your personal data in a structured, commonly used and machine-readable (portable) format, , as well as the right to object to any processing that is not in compliance with the applicable laws, or for reasons related to your particular situation in cases where data processing is necessary for the purposes of the legitimate interests of SAIPEM as the data controller or a third party, stating explicitly which interests or
fundamental rights and freedoms of yours requiring protection of personal data override the legitimate interests of SAIPEM or the third party, or restriction of disclosure to third parties that is not in compliance with the applicable laws and this Information Notice. In addition, only in case the data are processed on the basis of your consent, you may revoke your consent at any time with effect for the future.
You are aware that a deletion, hand-over in a portable format, restriction of processing or of disclosure to third parties or revocation of your consent for processing of your personal data may mean that your application can no longer be considered.
